Karnataka High Court: Salary of officer relieved without next posting to be recovered from authority who ordered transfer
Bengaluru : The Karnataka High Court has ruled that if a government officer is relieved from a post without being simultaneously given a fresh posting, the salary paid for the intervening period cannot be denied to the officer and may instead be recovered from the official responsible for issuing such an order. Court’s key observations The Court observed that an employee cannot be made to suffer financially due to administrative lapses or arbitrary decisions of authorities. I
