High Court Seeks Government Response in Ex-Councillor Pooja Naik Caste Certificate Case

The Bombay High Court at Goa has sought a response from the state government in connection with a petition filed by former municipal councillor Pooja Naik challenging the cancellation of her caste certificate and her subsequent disqualification from the municipal council.

The case came up for hearing on Monday after Naik, who served as a councillor in the Margao Municipal Council, approached the court against the decision that revoked her caste certificate. Following the cancellation, she was disqualified from holding her position in the civic body.


Government’s Submission in Court

During the hearing, the Government of Goa informed the court that individuals seeking benefits under reserved categories must ensure that their caste certificates are properly verified and approved by the competent authority.

The government stated that scrutiny of caste certificates is essential to ensure that only eligible individuals receive benefits or contest elections under reserved categories.


Petition Challenges Revocation

In her petition, Pooja Naik has challenged the decision to revoke her caste certificate, arguing that the action led to her disqualification from the municipal council. She has requested the court to review the legality of the decision and grant relief.

The petition raises questions regarding the process followed in the cancellation of the certificate and whether due procedure was followed before the action was taken.


Court Directs Government to File Reply

After hearing preliminary arguments, the High Court directed the Goa government to submit a formal response in the matter. The court will examine the government’s reply and other documents before deciding on the next course of action.


Case Under Judicial Review

The matter is currently under judicial consideration, and the court’s eventual ruling could determine whether Naik’s disqualification from the municipal body will stand or if she may receive legal relief.

Legal experts say the case may also clarify procedures related to verification and cancellation of caste certificates in electoral matters.
