Prashant Kishor’s Jan Suraaj Moves Supreme Court to Nullify Bihar Poll Results, Seeks Fresh Elections

New Delhi:The Jan Suraaj Party, founded by political strategist Prashant Kishor, has approached the Supreme Court seeking to declare the 2025 Bihar Assembly election results null and void, alleging large-scale violations of electoral norms by the state government during the election period.

In a writ petition filed under Article 32 of the Constitution, the party has urged the apex court to order fresh elections in Bihar, contending that the ruling dispensation compromised the level playing field by announcing and disbursing financial benefits to women voters while the Model Code of Conduct (MCC) was in force.

Allegations of Cash Transfers During MCC

According to the petition, the Bihar government transferred ₹10,000 each through Direct Benefit Transfer (DBT) to one woman per family under the Mukhyamantri Mahila Rojgar Yojana during the subsistence of the MCC and in the midst of the Assembly elections.

The Jan Suraaj Party has alleged that the scheme benefitted around 25 to 35 lakh women voters, calling the move a calculated attempt to influence voters and tilt the electoral process in favour of the ruling party.


‘Gratification and Corrupt Practices’ Alleged

The petition claims that the disbursal of funds amounted to “gratification, bribery, and corrupt practices” under election law, and directly violated the principles of free and fair elections guaranteed under the Constitution.

The party further argued that such welfare disbursements during the election period erode public trust in democratic institutions and undermine the authority of the Election Commission of India.


Relief Sought

Apart from seeking the quashing of the election results, Jan Suraaj has also requested the Supreme Court to issue appropriate directions to ensure strict enforcement of the Model Code of Conduct in future elections, particularly with respect to government welfare schemes.


Matter Likely to Have Wider Implications

Legal experts said the petition could have far-reaching implications if admitted, as it raises critical questions about the timing of welfare schemes, DBT transfers, and their impact on electoral fairness.

The Supreme Court is yet to list the matter for hearing.
