Punjab and Haryana HC Denies Relief to Kathua Rape-Murder Convict

The Punjab and Haryana High Court has ruled that a convict in the sensational Kathua rape-murder case does not deserve any concession, rejecting his plea for suspension of sentence.

Court Rejects Plea

A division bench comprising Justice Gurvinder Singh Gill and Justice Ramesh Kumari passed the order while hearing a petition filed by convict Sanji Ram. The plea sought suspension of his sentence, a legal provision that allows temporary relief during the pendency of an appeal.

The bench firmly stated that the nature and gravity of the crime did not warrant any such concession.

Seriousness of the Crime Highlighted

The court observed that the offence was extremely serious and had shocked the collective conscience of society. Given the severity of the allegations and the conviction, the bench held that granting relief at this stage would be inappropriate.

No Grounds for Suspension of Sentence

The judges noted that the petitioner had failed to present sufficient grounds to justify suspension of the sentence. They emphasized that such relief cannot be granted routinely, especially in cases involving heinous crimes.

Background of the Case

The Kathua rape-murder case had drawn nationwide outrage due to its brutality. Several accused were convicted for their roles in the crime, and the case continues to be closely followed.

Legal Implications

The High Court’s decision reinforces a strict stance on crimes of a grave nature, signaling that courts may be reluctant to grant interim relief to convicts in such cases without compelling reasons.

What Lies Ahead

The convict may still pursue further legal remedies as per law, but for now, the rejection of the plea means the sentence will continue to be in force.

The ruling underscores the judiciary’s commitment to ensuring justice in cases involving serious offences.
