Madhya Pradesh High Court Cancels Congress MLA’s Mukesh Malhotra Victory for Hiding Criminal Cases, Declares Former BJP Minister Elected

In a significant ruling, the Madhya Pradesh High Court has set aside the election victory of Congress MLA Mukesh Malhotra after finding that he had concealed details of pending criminal cases while filing his nomination. The court also declared former BJP minister Narayan Singh Kushwah Rawat as the duly elected candidate.

The verdict was delivered by a single bench of Justice Gurpal Singh Ahluwalia at the High Court bench in Gwalior while hearing an election petition filed by Rawat challenging the results of the Assembly election.

Court Finds Suppression of Information

In its judgment, the court observed that Mukesh Malhotra had “deliberately and knowingly suppressed material information” related to the framing of charges in two criminal cases pending against him. The judge noted that such information was required to be disclosed in the affidavit submitted along with the nomination papers.

According to the court, by withholding this information, the Congress leader misled the electorate and violated election norms designed to ensure transparency in the democratic process.

Petition by BJP Leader

The election petition had been filed by Narayan Singh Kushwah Rawat, who contested the seat as a candidate of the Bharatiya Janata Party. Rawat alleged that Malhotra failed to disclose crucial details about the criminal charges framed against him, which could have influenced voters’ decisions.

After examining the evidence and legal arguments presented during the hearing, the court ruled in Rawat’s favour.

Election Result Set Aside

The High Court declared Malhotra’s election invalid and subsequently recognised Rawat as the winning candidate for the Assembly seat.
